Terms and conditions
Moving contracts are governed by the statutory provisions of §§ 451 ff. HGB together with the terms below.
1. Scope
These terms apply to moving, packing, assembly, transport and storage services provided by Martin Marcinko under the trading name SuperUmzug.
For moving contracts with consumers, the mandatory provisions of §§ 451 ff. HGB take precedence.
2. Quote and fixed price
The prices published on this website are market orientation values and are not an offer in the legal sense.
A binding offer is made only after a survey on site or by photo and video. It is issued in text form and states scope, crew, date and fixed price.
The fixed price applies to the scope described in the quote. Additional scope and extra work are charged only after prior agreement.
3. Prices and VAT
Prices quoted to consumers are gross and include statutory VAT, currently 19 %.
For business customers VAT is shown separately.
Surcharges: Saturday 50 %; Sundays and public holidays, and express moves within 24 hours, at double rate.
4. Sunday and public-holiday work
Work on Sundays and public holidays is possible only by arrangement and only within the exceptions permitted by § 9 of the German Working Hours Act. There is no entitlement to an appointment on those days.
5. The customer's obligations to cooperate
The customer ensures that both addresses are accessible on the agreed date and that keys and a contact person are available.
Furniture must be emptied before dismantling and transport unless otherwise agreed.
Valuables, cash, jewellery, securities, documents and medication are not part of the consignment and must be carried by the customer.
Dangerous goods — in particular fuels, gas bottles, paints and solvents in larger quantities, and pyrotechnics — are not carried.
6. Goods not carried
We do not carry pianos, grand pianos, safes, billiard tables or industrial machinery, nor items requiring a crane or removal through a window or balcony.
Hot tubs and saunas are carried up to 120 kg, large potted plants up to 100 kg.
Live animals are not carried.
Where a furniture hoist is required, it is booked from a third-party supplier and charged separately.
7. Liability
The statutory liability for moving contracts under §§ 451 ff. HGB applies, in particular the liability cap of 620 euro per cubic metre of loading space required to fulfil the contract (§ 451e HGB).
Damage must be reported under § 438 HGB: externally visible damage at the latest on delivery, damage not externally visible within fourteen days of delivery, in text form.
Where the customer packed the goods, liability for transport damage to the contents is limited so far as the damage is attributable to that packing (§ 451d HGB).
Transport insurance beyond the statutory liability can be agreed for the whole move or for individual valuables; the premium follows the value declared by the customer.
Damage outside the consignment is covered by public and professional liability insurance (LVN).
8. Storage
For the period of storage it is not the transport liability under § 451e HGB that applies but the separately agreed storage contract with its own terms, which is attached to the quote.
9. No-parking zones
On request, no-parking zones are applied for at the competent authority for both addresses. The application requires roughly three weeks' lead time.
We give no warranty as to the effectiveness of an ordered zone against third parties; if a vehicle parks in the zone despite correct signage, ordering its removal is a matter for the police or the municipal traffic enforcement service.
10. Volume calculator
The estimate of volume, crew size and price band shown in the volume calculator is non-binding and does not constitute an offer.
A binding fixed price arises solely from a quote issued in text form after a survey.
